Red Army soldier. In September 1941, he was sentenced under Article 58-10 of the Criminal Code of the RSFSR to 8 years in a labor camp. He was transferred from Leningrad prison to Tomsk prison.

Born in 1913 in the village of Bratki, Ternovsky District, Voronezh Region, Russian, from middle peasants, no pension, collective farmer, basic education, married. Before conscription, he lived at his place of birth. Joined the Red Army on June 23, 1940, called up by the Ternovsky RVC. Served as a Red Army soldier in the 452nd Rifle Regiment of the 168th Rifle Division. He was arrested in July–August 1941 on charges that “from July 24 of this year, among the Red Army soldiers of his and a neighboring unit, he interpreted the beginning of military actions between the USSR and Nazi Germany from an anti-Soviet position and, in addition, made slanderous remarks about one of the leaders of the party and government of the Soviet Union,” i.e. a crime under Art. 58-10 Part 2 of the Criminal Code of the RSFSR (“Propaganda or agitation containing calls for the overthrow, undermining or weakening of Soviet power... committed in a military situation”).

On August 16, 1941, the Military Tribunal of the 19th Rifle Corps passed a sentence - the highest measure of punishment (execution), the convicted man was sent to the NKVD Directorate for the Leningrad Region for execution of the sentence, where he was held in custody.

By the decision of the Leningrad Front Military Tribunal of September 5, the previous sentence was overturned on the grounds that witnesses had not been questioned, the accused had not admitted guilt, and the case was sent for further investigation.

By the verdict of the 55th Army on September 9, 1941, Golubykh was sentenced to 8 years of imprisonment in a labor camp and 4 years of deprivation of rights. He was sent to serve his sentence in the GULAG camps.

The Commission under the Presidium of the Supreme Soviet of the USSR rejected N. I. Golubykh's petition for pardon.

On November 15, 1941, he was taken to prison No. 3 of the NKVD NSO (Tomsk). His subsequent fate has not been revealed in archival documents.

He may have died in prison at the end of December 1941. The basis is the inscription on the inside cover of the file that the information was transferred to the Tomsk OAGS, dated January 2, 1942.

Copy of the ruling of the Leningrad Front Military Tribunal No. K-1382 of September 5, 1941. The tribunal reviewed the protest against the verdict of the Military Tribunal of the 19th Rifle Corps of August 16, 1941 on the execution of Golubykh N. I. under Article 58-10, Part 2 of the Criminal Code of the RSFSR. The verdict was overturned due to the incompleteness of the judicial investigation (witnesses Sonin and Polyakov were not interrogated). The case was sent for a new trial to the Military Tribunal of the 55th Army. The preventive measure (detention) was left unchanged.

Having considered in the session of September 5, 1941 the protest in the supervisory procedure of the Chairman of the Military Tribunal of the Leningrad Front against the sentence of the Military Tribunal of the 19th SK, of August 16, 1941, in the case of Nikolai Ivanovich GOLUBYKH, sentenced under Article 58-10, Part 2 of the Criminal Code to death by firing squad.

The protest was filed to overturn the sentence and send the case back to the Supreme Court for a new trial.

Having heard the report of Comrade KOROTAYEV, the conclusion of the Deputy Prosecutor of the Leningrad Front Comrade KHAKINA, who supports the protest.

D E F I N G:

The verdict of the VT is based only on the materials of the preliminary investigation, not verified during the trial. The witnesses SONIN and POLYAKOV, who were summoned to the court, did not appear for a completely unspecified reason, and given that GOLUBYKH did not admit his guilt in anti-Soviet agitation and denied the testimony of the witnesses in this part, the appearance of the witnesses should have been recognized as necessary. By failing to do this, the VT issued a verdict based on insufficiently examined case materials...

In view of the above, in agreement with the protest of the Chairman of the Military Tribunal, the verdict of the Military Tribunal is overturned and the case is transferred for a new trial to the Military Tribunal of the 55th Army.

The measure of restraint for the Blues will remain unchanged.

considered case No. 03 on charges of Red Army soldier of the 462nd Rifle Regiment, Nikolai Ivanovich GOLUBYKH, born in 1913, native of the village of Bratki, Ternovsky District, Voronezh Region, from the middle peasants, collective farmer, Russian, with a lower education, non-party member, married, no criminal record, in the Red Army since June 23, 1940, called up by the Ternovsky RVC, lived at his place of birth before being called up, in a crime under Art. 58-10 Part 2 of the Criminal Code of the RSFSR.

The materials of the preliminary and judicial investigation ESTABLISHED:

GOLUBYKH, on July 24 of this year, among the Red Army soldiers of his and a neighboring unit, interpreted the beginning of military actions between the USSR and Nazi Germany from an anti-Soviet position and, in addition, made slanderous remarks about one of the leaders of the party and government of the Soviet Union, thereby GOLUBYKH committed a crime provided for in Article 58-10, Part II of the Criminal Code, therefore, guided by Articles 319 and 320 of the Criminal Procedure Code

S E R V E R I N G:

Golubykh, Nikolai Ivanovich, on the basis of Part II of Article 58-10 of the Criminal Code with the sanction of Article 58-2 of the Criminal Code, to deprive him of liberty in a correctional labor camp for a period of EIGHT YEARS, with deprivation of political rights provided for in paragraphs: "a", "b", "c" and "d" of Article 31 of the Criminal Code for a period of FOUR years, without confiscation of property due to the absence thereof.

The initial term of serving the sentence, taking into account the preliminary imprisonment of the BLUE, is calculated from August 2, 1941.

The verdict is final and cannot be appealed.
