Copy of the ruling of the Leningrad Front Military Tribunal No. K-1382 of September 5, 1941. The tribunal reviewed the protest against the verdict of the Military Tribunal of the 19th Rifle Corps of August 16, 1941 on the execution of Golubykh N. I. under Article 58-10, Part 2 of the Criminal Code of the RSFSR. The verdict was overturned due to the incompleteness of the judicial investigation (witnesses Sonin and Polyakov were not interrogated). The case was sent for a new trial to the Military Tribunal of the 55th Army. The preventive measure (detention) was left unchanged.

DEFINITION No. K-1382.
Military Tribunal of the Leningrad Front, consisting of:
presiding Brigade Military Lawyer MARCHENKO,
Members: Military lawyer 3rd rank KOROTAEV, comrade MERKUSHEVA,
Having considered in the session of September 5, 1941 the protest in the supervisory procedure of the Chairman of the Military Tribunal of the Leningrad Front against the sentence of the Military Tribunal of the 19th SK, of August 16, 1941, in the case of Nikolai Ivanovich GOLUBYKH, sentenced under Article 58-10, Part 2 of the Criminal Code to death by firing squad.
The protest was filed to overturn the sentence and send the case back to the Supreme Court for a new trial.
Having heard the report of Comrade KOROTAYEV, the conclusion of the Deputy Prosecutor of the Leningrad Front Comrade KHAKINA, who supports the protest.
D E F I N G:
The verdict of the VT is based only on the materials of the preliminary investigation, not verified during the trial. The witnesses SONIN and POLYAKOV, who were summoned to the court, did not appear for a completely unspecified reason, and given that GOLUBYKH did not admit his guilt in anti-Soviet agitation and denied the testimony of the witnesses in this part, the appearance of the witnesses should have been recognized as necessary. By failing to do this, the VT issued a verdict based on insufficiently examined case materials...
In view of the above, in agreement with the protest of the Chairman of the Military Tribunal, the verdict of the Military Tribunal is overturned and the case is transferred for a new trial to the Military Tribunal of the 55th Army.
The measure of restraint for the Blues will remain unchanged.
Authentic with proper signatures.

I APPROVE:
DEPUTY CHIEF OF THE NKVD DEPARTMENT OF THE NSO STATE SECURITY MAJOR /KORNILEV/
I AUTHORIZE ARREST:
PROSECUTOR OF NOVOSIBIRSK REGION STATE COUNSELLOR OF JUSTICE III CLASS [signature]
DECREE / For arrest /
City. Tomsk Novosibirsk region "__" February 1944
I, Deputy Head of Prison No. 3 of the NKVD of the Novosibirsk Region, Junior Lieutenant of State Security BASHLYKOV, having reviewed the material on criminal activity:
KRAUSS Karl Gottliebovich, born in 1905, native of the village of Orlovskoye, Markshtatsky District, Volga German ASSR, German by nationality, citizen of the USSR, no permanent residence, illiterate, from the middle peasants, without a permanent place of residence or work, was exiled to the Kozhevnikovsky District of the Novosibirsk Region, from where he fled. For which he was arrested on 23.V.43 by the Tugansky ROM NKVD and charged under Art. 82, Part II of the Criminal Code of the RSFSR, and is currently being held in Prison No. 3 in Tomsk.
FOUND:
That KRAUSS, while under arrest in prison No. 3 of the NKVD NSO during November–December 1943, systematically carried out counter-revolutionary [pro-fascist] agitation among his cellmates, aimed at undermining the power of the Soviet state, for example:
In mid-November 1943, KRAUSS denigrated the Soviet government and the leaders of the All-Union Communist Party (Bolsheviks), and made various insults against the leaders of the All-Union Communist Party (Bolsheviks). Here he also praised the cannibal Hitler and his “order.”
In the last days of November 1943, KRAUSS slandered the Red Army and, on the contrary, praised the German army and its equipment, proving to his cellmates the inevitable defeat of the USSR in the modern war with Nazi Germany.
In the first days of December 1943, KRAUSS made slanderous statements about the Soviet government and the Red Army. At the same time, he praised the German army and the bandit Hitler.
In the last days of December 1943, KRAUSS expressed similar counter-intelligence fabrications, and simultaneously slandered the Soviet press.
The pro-fascist activities of KRAUSS are confirmed by the testimony of witnesses VYKHREST P.E., FEDOSEYEV A.K., RYABKOV T.P. and MAKARENKO A.I.
Based on the above
