Baukov Andrey Pavlovich
Worker at a timber transshipment depot, Tomsk. Convicted under Art. 58-12 (1940)
Born in 1919 in Zyryansky district of Novosibirsk region, village of Cherdaty. Russian, primary education, no first name.
In 1926, my father’s family was deprived of voting rights (F. R-1041, op. 1, d. 671).
Special settler. In 1939: single, worked at a timber transshipment base, settlement Cheremoshniki, Tomsk district. Arrested on September 13, 1939. Was involved in the case of membership in a counter-revolutionary rebel group created by Baukov Pavel Alekseevich, his father.
On February 24, 1940, the Novosibirsk Regional Court charged him under Articles 19-58-2, 58-11. The sentence was 3 years in a labor camp and 3 years of deprivation of rights. An appeal was filed (Baukov P.A. and Volkov-Vilkin A.V.). By the decision of the Criminal Cases Collegium of the Supreme Court of the RSFSR on March 29, 1940, their appeal was considered. The charges against Andrei Pavlovich Baukov were reclassified:
"The charge against Andrei Baukov under Articles 19, 58-2, 58-11 of the Criminal Code has not been proven, since Andrei Baukov's forced consent to participate in a counter-revolutionary organization, given to Pavel Baukov under the influence of the latter's threats, cannot be considered as evidence of this charge. Andrei Baukov did not take any part in the work of this counter-revolutionary group. Andrei Baukov's actions must be reclassified under Article 58-12 of the Criminal Code, since he, knowing about the counter-revolutionary activities of the convicted persons, did not report this to the appropriate authorities... The court's sentence against Andrei Pavlovich Baukov must be changed, Andrei Baukov's actions must be reclassified under Article 58-12 of the Criminal Code, and the punishment chosen by the court must be left unchanged."
Date of rehabilitation: August 1960.
