I, Head of the 2nd Department of the 3rd Department of the UGB NKVD for the Novosibirsk Region - GOLOVIN , having examined the investigative materials regarding citizen DEYEV Tikhon Sergeevich, 55 years old, Russian, citizen of the USSR, no pension, literate, native of the village of Sukhoi Log, Zyryansky District, a migrant worker, currently residing in the village of Cheremoshniki, Tomsk District, pensioner,

FOUND:

That DEEV is suspected of crimes under Articles 19-58, paragraph 8 and 58, paragraph 11 of the Criminal Code of the RSFSR and taking into account that DEEV, while at large, may hide from the investigation and trial and continue his counter-revolutionary activities.

Guided by Articles 145 and 158 of the Criminal Procedure Code of the RSFSR, -

RESOLVED:

As a measure of prevention of methods of evading investigation and trial for Tikhon Sergeyevich DEEV, detention in custody shall be chosen, about which, in accordance with Article 146 of the Criminal Procedure Code of the RSFSR, the arrested person shall be notified against a receipt in this resolution.

In accordance with Article 160 of the Criminal Procedure Code of the RSFSR, a copy of the order shall be sent to the prosecutor and transferred to the head of the prison for inclusion in the prison’s personal file.

(On extending the investigation period).

I, Senior Officer of the Prokopyevsk City NKVD – Junior Lieutenant of State Security TYULKOV, having examined investigative case No. 74 on charges against Tikhon Sergeevich DEYEV, Semyon Sergeevich DEYEV, Pavel Alekseevich BAUKOV and others, accused of a crime under Articles 19-58-2, 58-10, 58-11 of the Criminal Code of the RSFSR,

FOUND

DEEV Tikhon Sergeevich, born in 1879, native of the village of Bogoslovka, Zyryanovsky district, Novosibirsk region, from the kulaks, a labor migrant. In 1919-1922 he served in Kolchak's punitive detachment.

Arrested on September 13, 1939, charged under Articles 19-58-2, 58-10-11 of the Criminal Code on September 25, 1939.

On the merits of the charges brought against him, he was questioned 4 times: 15/IX, 18/IX, 14/X,

As a participant in a counter-revolutionary rebel group, he did not admit guilt, but admitted that at the time of his recruitment into the organization, DEEV took on the obligation to provide all possible assistance to the rebel organization at the time of its action.

Convicted by the testimony and confrontation of BAUKOV P.A., the testimony of DEYEV S.S.

Taking into account that the investigation period expires on November 13, 1939, the following must be done: conduct a confrontation between DEYEVA T.S. and DEYEV S.S.

Interrogate 2-3 witnesses who know about the counter-revolutionary activities of DEEVA T.S. Conduct confrontations with them.

And therefore, guided by Article 116 of the Code of Criminal Procedure of the RSFSR,

DECIDED

File a petition with the Military Prosecutor of the Siberian Military District to extend the investigation period and to detain the accused Tikhon Sergeyevich DEYEV for a period of 20 days, i.e. until December 1, 1939.

Томска.

8. ОДИНЦЕВА Якова Павловича, 1907 г.р. ур. дер. Орешенки, Кировской области, из крестьян-средняков, м/грамотный, семейный, не судившийся, последнее время проживал в дер. Березовка, Зырянского р-на, НСО, по ст. 19-58-2, 58-10 ч.1 и 58 п.11 УК.

Данными предварительного и судебного следствия суд считает установленным, что подсудимый БАУКОВ Павел, будучи враждебно настроенным к Советской власти еще в 1919 г., состоя в карательном отряде Колчаковского офицера КАРЗИЛОВА, оперировавшегося в Зырянском районе, вел активную борьбу против советской власти путем вылавливания Красных партизан, сочувствующих Советской власти и лично сам подвергал пыткам и расстрелам.

В январе мес.1934 г., после отбытия десятилетнего наказания за организацию террора над участковым милиционером, встретился с бывшим Белогвардейским офицером КРОПЕНЕВЫМ, с которым договорился проводить работу по созданию контрреволюционной организации для борьбы с Советской властью. Выполняя контрреволюционные задания белогвардейского офицера КРОПЕНЕВА, по заданию контрреволюционной повстанческой организации, подсудимый БАУКОВ Павел стал выявлять антисоветски настроенных из числа спецпереселенцев и вербовать в контрреволюционную повстанческую организацию. В том же январе мес. 1934 г. им было завербованы кулаки: АЛИН Константин, РУБЦОВ Егор, РЫКОВ Павел. В июне мес. 1934 г. в пос. Симоново, Зырянского р-на, завербовал АЛИНА Николая и АЛИНА Федора, которым дал задание проводить вербовку новых лиц.

В 1935 г. подсудимый БАУКОВ Павел в с. Орехово, Зырянского р-на, завербовал в к-р организацию кулаков: КЕРТ Александра и ОНГА Ивана.

В 1936 г. в сентябре мес. Завербовал в контрреволюционную организацию подсудимого ТУРУКИНА Ивана, который в то время проживал в с. Сухой лог., Зырянского р-на.

В 1938 г. подсудимый БАУКОВ Павел переехал на работу в спецпоселок Черемошники гор. Томска, где 1-го мая в квартире спецпереселенца БАЖЕНОВА, проводя контрреволюционные разговоры, вовлек в контрреволюционную организацию подсудимых: АЛЕКСЕЕНКО, ДЕЕВА Семена и БАЖЕНОВА, последние дали согласие вести активную борьбу против Советской власти. В июле мес. 1939 г. БАУКОВ Павел вовлек в контрреволюционную организацию своего сына – БАУКОВА Андрея. В том же мес. В квартире подсудимого ДЕЕВА Тихона, в присутствии ДЕЕВА Семена и свидетеля БЕЛОШИНСКОГО, БАУКОВ Павел проводил контрреволюционные разговоры. ДЕЕВ Семен давая оценку событиям в МНР высказывал необходимость уйти в тайгу, а подсудимый ДЕЕВ Тихон, поддерживая к-р разговор, заявил, что вследствие инвалидности в тайгу идти не может, но будет оказывать всю возможную поддержку.

9-го июля 1939г. в квартире подсудимого ВОЛКОВА-ВИЛКИНА, БАУКОВ Павел в беседе с МАНГАЗЕЕВЫМ вел контрреволюционные повстанческие разговоры, что слышал и подсудимый ВОЛКОВ-ВИЛКИН.

Исходя из вышеизложенного суд НАШЕЛ, что предъявленное обвинение БАУКОВУ Павлу, ДЕЕВУ Семену, ДЕЕВУ Тихону, АЛЕКСЕЕНКО, ТУРКИНУ – по ст.ст. 19, 58 п. 2,. 58 п.10 ч.1 и 58 п.1 11 УК. доказано полностью.

Предъявленное же обвинение ВОЛКОВУ-ВИЛКИНУ по ст. [?] 19 п.58.2, 58 п.10 ч.1 и 58 п.11 УК. на судебном следствии считать не доказанным. Однако в судебном заседании установлено, что подсудимому ВОЛКОВУ-ВИЛКИНУ было известно о к-р деятельности БАУКОВА Павла и др., но не было заявлено в соответствующие органы, т.е. совершил преступление предусмотренное ст.58 п.12 УК.

Предъявленное обвинение по ст. 58 п.10 ч.1 УК БАУКОВУ Андрею, на судебном следствии считать недоказанным. Также считать недоказанным предъявленное обвинение по ст.ст. 19, 58-2 п.58-10 ч.1 и 58 п.11 УК обвиняемому ОДИНЦЕВУ, так как ни показаниями обвиняемых, ни показаниями свидетелей участие в агитации не доказано.

Руководствуясь ст.ст. 319, 320 и 326 УПК. -

ПРИГОВОРИЛА:

ОДИНЦЕВА Якова Павловича по суду считать оправданным и из под стражи немедленно освободить.

ВОЛКОВА-ВИЛКИНА Александра Васильевича на основании ст. 58 п.12 УК.

БАУКОВА Андрея Павловича, на основании ст.19, 58п.2, 58 п.11 УК. Подвергнуть лишению свободы в исправтрудлагерях сроком на три года каждого, с поражением в правах по п. п. «А» и «Б» ст. 31 УК сроком на три года каждого.

ТУРУКИНА Андрея Панфиловича, ДЕЕВА Тихона Сергеевича, ДЕЕВА Семена Сергеевича и АЛЕКСЕЕНКО Максима Кирилловича по ст. 58 п. 10 ч. 1 УК подвергнуть лишению свободы в исправтрудлагерях сроком на три года каждого, а по ст.ст. 19 58 п.2, 58 п.11 УК. сроком на пять лет каждого и по совокупности обоих преступлений на пять лет каждого с поражением в правах по п.п. «а» и «б», ст. 31 УК. сроком на три года каждого.

БАУКОВА Павла Алексеевича подвергнуть высшей мере наказания – РАССТРЕЛУ.

Зачесть предварительное заключение АЛЕКСЕЕНКО, БАУКОВУ Андрею, ДЕЕВУ Семену, ВОЛКОВУ, ДЕЕВУ Тихону с 13 сентября 1939 г.

under Article 19-58-2-10-11 of the Criminal Code to five years of imprisonment; no complaint was received from the last cassation office and the sentence, as not appealed, entered into legal force on February 29, 1940.

ОПРЕДЕЛЕНИЕ

Судебная коллегия по Уголовным делам Верховного Суда РСФСР в составе: председательствующего Афонина, членов Швецова и Анисимовой.

Рассмотрела в заседании от 29 марта 1940 г. в касспорядке по жалобе БАУКОВА Павла Алексеевича, ВОЛКОВА-ВИЛКИНА Александра Васильевича и по протесту прокурора РСФСР – на приговор Новосибирского Областного суда от 18-24 февраля 1940 г. по делу осуждены:

1. ВОЛКОВ-ВИЛКИН Александр Васильевич по ст.58-12 УК., 

2. БАУКОВ Андрей Павлович по ст. 19-58-2,58-11 УК 

к лишению свободы на три года каждый с поражением в правах по п.п. «а» «б» ст. 31 УК на три каждого.

3. ТУРУКИН Андрей Панфилович, 

4. ДЕЕВ Тихон Сергеевич, 

5. ДЕЕВ Семен Сергеевич и 

6. АЛЕКСЕЕНКО Максим Кирилович 

по ст.58-10 ч.1 УК к лишению свободы на три года каждый, по ст. 19-58-2, 58-11 УК. К лишению свободы на пять лет каждый и по совокупности преступлений к лишению свободы на пять лет каждый с поражением в правах по п.п. «а»б» ст.31 УК на три года каждого.

7. БАУКОВ Павел Алексеевич по ст.ст. 19-58-2, 58-10 ч.1 и 58-11 УК к высшей мере наказания расстрелу.

7. ОДИНЦОВ Яков Павлович по суду оправдан.

Заслушав члена докладчика т. Швецова, заключение прокурора Латыниса, полагавшего приговор суда в отношении Баукова Павла, Волкова-Вилкина и Одинцова оставить в силе, а в отношении Баукова Андрея приговор суда изменить, действия Баукова Андрея переквалиицировать на ст.58-12 УК., а в отношении Алексеенко, Деева Семена, Турукина и Деева Тихона приговор суда отменить за мягкостью.

Судебная коллегия по уголовным делам Верховного Суда РСФСР находит:

Бауков Павел, будучи враждебно настроен к советской власти еще в 1919 г. состоял в карательном отряде Колчаковского офицера Карзилова, оперировавшего в Зырянском районе, вел активную борьбу против советской власти, лично производил пытки и расстрелы красных партизан.

В январе месяце 1934 г. после отбытия наказания за террористический акт против участкового милиционера, Бауков Павел стал выявлять антисоветские настроенные элементы из числа спецпереселенцев и вербовать в контр-революционную повстанческую организацию. Эту контрреволюционную работу Бауков Павел вел вплоть до его ареста. В контрреволюционную организацию им было завербовано 11 человек. Своей конечной целью повстанческая контрреволюционная группа ставила свержение советской власти путем вооруженного восстания.

Преступление осужденного Баукова Павла подтверждено признанием самого осужденного и материалами дела.

Волкову-Вилкину было известно о контрреволюционной деятельности Баукова Павла и др. осужденных, однако об этом Волков-Вилкин не заявил в соответствующие органы.

Преступление осужденного Волкова-Вилкина подтверждено показаниями осужденного Баукова Павла, признанием самого осужденного Волкова-Вилкина.

Доводы осужденного Баукова Павла, изложенные в его жалобе о том, что им контрреволюционная повстанческая организация не была создана – не основательна и опровергается показаниями самого осужденного Баукова Павла (л.д. 204 об).

Просьбы осужденного Баукова Павла о снижении ему меры наказания удовлетворению не подлежат, т.к. мера наказания осужденному Баукову определена судом правильно, в соответствии с тяжестью совершенного им преступления и с учетом личности осужденного.

Доводы осужденного Волкова-Вилкина в его жалобе о том, что он не знал о контрреволюционной деятельности осужденных, следовательно, якобы в его действиях нет состава преступления не обоснованы и опровергаются показаниями самого же осужденного Волкова-Вилкина (л.д. 225).

Обвинение пред"явленное Одинцову по делу на доказано. 

Таким образом, приговор суда в отношении Баукова Павла, Волкова-Вилкина и Одинцова вынесен правильно.

Приговор суда в отношении Баукова Андрея подлежит изменению. Обвинение Баукова Андрея по ст.ст. 19, 58-2, 58-11 УК не доказано, ибо нельзя считать доказательством этого обвинения вынужденное согласие Баукова Андрея быть участником контрреволюционной организации, данное им Баукову Павлу под влиянием угроз последнего. Никакого участия в работе этой контрреволюционной группы Бауков Андрей не принимал.

Действия Баукова Андрея надлежит переквалифицировать на 58-12 УК, поскольку он зная о контрреволюционной деятельности осужденных не сообщил об этом в соответствующие органы.

Приговор суда в отношении Турукина, Деева Семена, Алексеенко и Деева Тихона подлежит отмене по следующий основаниям: Турукин, Деев Семен, Алексеенко и Деев Тихон признаны виновными в том, что являлись членами контрреволюционной повстанческой организации, принимали участие в контрреволюционных сборищах, где и вели антисоветскую агитацию и обсуждали вопросы подготовки вооруженного восстания против советской власти.

Между тем суд при определении им меры наказания не учел личности осужденных и вынес явно мягкий приговор. Турукин, Деев Семен, Деев Тихон и Алексеенко кулаки, лишались избирательных прав, хозяйство их раскулачено и они все были высланы и до ареста находились в спецпереселении.

К тому же из показаний свидетелей на судебном следствии Тетина, Гайдукова и Писанко видно, что Деевы в 1919 г. оказывали, активную помощь карательному отряду колчаковской армии.

На основании изложенного Судебная коллегия по уголовным делам Верховного Суда РСФСР

ОПРЕДЕЛИЛА:

Приговор суда в отношении Баукова Павла Алексеевича, Волкова-Вилкина Александра Васильевича и Одинцова Якова Павловича оставить в силе, а жалобы Баукова Павла и Волкова-Вилкина оставить без удовлетворения.

Приговор суда в отношения Баукова Андрея Павловича изменить, действия Баукова Андрея переквалифицировать по ст. 58-12 УК, а меру наказания оставить без изменения избранную судом.

Приговор суда в отношении Турукина Андрея Панфиловича, Деева Тихона Сергеевича, Деева Семена Сергеевича и Алексеенко Максима Кириловича отменить и дело в отмененной части передать на новое рассмотрение в тот же суд в ином составе судей со стадии судебного следствия.

Medical examination of the corpse on May 3, 1941, based on instruction #60369 and the order of the head of the prison, comrade BOZHOK, head of the sanitary unit, doctor EREMINA, in the presence of prison DPN OSIPCHUK. An external examination of the corpse of prisoner Tikhon Sergeyevich DEYEVA, born in 1881, tall, of correct build, with [??] emaciation, who died in the hospital of prison #3, was performed. Cadaveric death has occurred.

The scalp is very pale for damage, the facial coverings are pale, the mucous membranes of the lips are cyanotic, the mouth is slightly open, the tongue is behind the teeth. The neck is long, the coverings on it are pale without damage. The chest is cylindrical, the ribs stick out sharply. The abdomen is sunken, the coverings on it are pale. The genitals are normal. The openings of the nose, ears, and anus are without foreign objects. The bones of the upper and lower limbs are undamaged, on the skin of the shoulder of the right arm there are traces of injections during life.

No other changes were found during external examination of the body.

Based on the above and case history No. 346-10 of 1941, the death of prisoner T.S. DEYEV was natural and resulted from senile decrepitude with a heart defect.
